Tap2Own takes its responsibilities under applicable privacy laws including the Personal Data Protection Act 2010 and other applicable data protection or privacy laws and regulations (hereinafter referred to as the "Privacy Laws") seriously and is committed to respecting the privacy rights and concerns of all subscribers of our Tap2Own website and/or platform (hereinafter referred to as the "Site"). For the purpose of this Privacy Policy, we shall refer to the Site and the services we provide as described in our Site collectively as the “Services”.

    3. “Personal data” means any personal data or information that has been provided to Tap2Own or made available to us, it shall be deemed that Tap2Own has been given consent to collect, record, hold, use, disclose, store and process the customer’s personal data which is in the possession, control and management of the authorised entity governing the operation and management of the premises, e.g. name, identity card or passport number, address, email address, contact number, copies and details of identification documents, contact details, bank account number, employment history, credit and references check, marital status, health status, commission or alleged commission of offence, personal financial and social security detail that relates directly or indirectly to an individual to the extent that the individual can be identified or is identifiable from such information

Our Site (i.e. mobile applications) may collect precise information about the location of your mobile device using technologies such as GPS, Wi-Fi, etc. We collect, use, disclose and/or process this information for one or more purposes including, without limitation, location-based services that you request or to deliver relevant content to you based on your location or to allow you to share your location to other subscribers as part of the Services under our mobile applications. For most mobile devices, you are able to withdraw your permission for us to acquire this information on your location through your device settings.   3. What Personal Data Will Tap2Own Collect?

    1. In order to enable us to deal with your inquiries and/or to generally provide you with our Services, we may need to and/or may be required to collect, record, hold, store, use and/or disclose your personal data, which includes any data which relates directly or indirectly to you and/or your transactions with us. This data includes, but is not limited to:

      1. personal information typically collected on application forms, which include but not limited to, your name, address details, date of birth, telephone number, mobile phone number, email addresses;

      2. personal information such as your profile picture, photos or avatar, gender, age, ethnicity, marital status, educational level, occupation, salary range, interests, hobbies, precise location-based information and any other information you directly give us through our Site;

      3. personal information that pertains to you obtained indirectly through other sources (if any), in respect of which you have given your consent to them disclosing information relating to you and/or where they are not otherwise restricted including but not limited to information about the products and services you have purchased through our Site;

      4. personal information including your particulars, images and biometrics to establish your identity and background;

      5. personal information that you provide when you apply for any of our products and services, including your views or opinions made known to us via feedback or surveys;

      6. information about your risk profile, financial standing and/or business interests and assets;

      7. information which we may collect from written communication when you provide us with complaints or issue of inconveniences while using our Services and we may use it for the purposes of communicating with you and to efficiently manage your requests and to resolve any other issues you may face;

      9. information regarding customer activities on our websites and on our other products and services, which are aggregated and used to help us provide more useful information to our customers and to understand which parts of our websites, products and services are of most interest;

      10. information relating to your activities, habits, preferences and interests arising from your use of products and services on our Site, our partners or vendors; and/or

      11. other electronic data or information relating to you such as IP addresses, cookies, activity logs, online identifiers and location data through your usage of our Services.

    2. If you do not want us to collect the aforementioned information or personal data, you may opt out at any time by notifying our Data Compliance Officer in writing about it. Further information on opting out can be found in Clause 15 of this Privacy Policy, however, that opting out of us collecting your personal data or withdrawing your consent for us to collect, use or process your personal data may affect your use of the Services (e.g. opting out of the collection of location information will cause its location-based features to be disabled).

  4. Setting Up Aa Account

    1. In order to use certain functionalities of the Services, you will have to create a subscriber account (“Account”) which requires you to submit certain personal data.

    2. When you register and create an Account, we require you to provide us with your name and email address as well as a subscriber identification that you select (hereinafter referred to as the “subscriber ID”). We will also ask for certain information about yourself such as your telephone number, email address, shipping address, photo identification, bank account details, age, date of birth, gender, and interests. By submitting the requested documents, you acknowledge and consent to our collection, use, and processing of your information for verification purposes.

    3. Upon activating an Account, you will select a subscriber ID and password. Your subscriber ID and password will be used so you can securely access and maintain your Account.

    4. In accessing and utilizing the Services on the Site, you shall:

      1. ensure that all the details, information and/or documents submitted are true, accurate and not misleading;

      2. use your Account for its intended use only;

      3. use the Services in good faith and comply with this Privacy Policy and all applicable laws of Malaysia relating to the Services, (including but not limited to Bank Negara Malaysia (BNM)’s Rules and Regulations/Guidelines, Communication and Multimedia Act 1998, the Financial Services Act 2013, Unclaimed Money’s Act 1965, AMLATFPUAA), and all subsidiary legislations, rules and regulations, notices, instructions or directives issued thereunder by the government, relevant authorities and regulatory agencies, and/or any notices, instructions, directives or guidelines given by us in connection with the Services which may be amended from time to time; and

      4. take all reasonable steps to prevent the fraudulent, improper or illegal use of the Account and/or Services. You shall, if instructed by us, lodge a police report on the same and give us a certified true copy of such report.

    5. You Shall Not:-

      1. share your login credentials with third party;

      2. use the Services for any purpose which is against public interest, public order or national harmony or for any unlawful purposes including but not limited to vice, gambling or other criminal purposes whatsoever or transmitting any content which is offensive on moral, religious, communal or political grounds, or is abusive, defamatory or of an indecent, obscene or menacing character or in any other manner which may result in complaints, claims, disputes, penalties or liabilities to Tap2Own; and

      3. hack into, access, tamper, breach or circumvent any authentication or security of any host, network or account of Tap2Own or its provider’s computer systems or interfere with service to any user, host or network, including, without limitation, sending a virus.

    6. You acknowledge that the Services are, and shall remain, at all times, the property of Tap2Own and you shall:-

      1. exercise all due care and diligence in the use and maintenance of the Account and Services; and

      2. not tamper or allow anyone to tamper with the Account and/or the Services in any way.

  5. Viewing Web Pages

    1. As with most websites, your computer sends information which may include personal data about you that gets logged by a web server when you browse our Site. This typically includes without limitation your computer's IP address, operating system, browser name/version, the referring web page, requested page, date/time, and sometimes a "cookie" (which can be disabled using your browser preferences) to help the Site remember your last visit.

    2. If you are logged in, this information is associated with your personal account. The information is also included in anonymous statistics to allow us to understand how visitors use our Site.

    1. We may from time to time implement "cookies" or other features to allow us or third parties to collect or share information that will help us improve our Site and the Services we offer or help us offer new services and features.

You acknowledge, consent and agree that Tap2Own may access, preserve and disclose your account information and content if required to do so by law or pursuant to an order of a court or by any governmental or regulatory authority having jurisdiction over Tap2Own or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (i) comply with legal process; (ii) comply with a request from any governmental or regulatory authority having jurisdiction over Tap2Own; (iii) enforce this Privacy Policy; (iv) respond to any threatened or actual claims asserted against Tap2Own or other claim that any content violates the rights of third parties; (v) respond to your requests for customer service; or (vi) protect the rights, property or personal safety of Tap2Own, its subscribers and/or the public.

  10. Does Tap2Own Disclose The Information It Collects From Its Visitors To Outside Parties?
    1. In conducting our business, we will/may need to disclose your personal data to our third party service providers, agents and/or our affiliates or related corporations, and/or other third parties, whether sited in Malaysia or outside of Malaysia, for one or more of the above-stated Purposes. Such third party service providers, agents and/or affiliates or related corporations and/or other third parties would be processing your personal data either on our behalf or otherwise, for one or more of the above-stated Purposes. Such third parties include, without limitation:

  12. How Does Tap2Own Protect And Retain Subscriber Information?

    1. We implement a variety of security measures and strive to ensure the security of your personal data on our systems. Subscriber’s personal data is contained behind secured networks and is only accessible by a limited number of employees who have special access rights to such systems. However, there can inevitably be no guarantee of absolute security.

    2. We will retain personal data in accordance with the Privacy Laws and/or other applicable laws. That is, we will destroy or anonymize your personal data as soon as it is reasonable to assume that: (i) the purpose for which that personal data was collected is no longer being served by the retention of such personal data; and (ii) retention is no longer necessary for any legal or business purposes.

If you cease using our Site, or your permission to use our Site and/or the Services is terminated or withdrawn, we may continue storing, using and/or disclosing your personal data in accordance with this Privacy Policy and our obligations under the Privacy Laws. We will use reasonable efforts to comply with your request to access or correct your personal data within twenty (21) days and the relevant processing fee (if any), subject to our right to rely on any statutory exemptions and/or exceptions. Please note that we may have to withhold access to your personal data in certain situations, for example when we are unable to confirm your identity or where the data requested for is of a confidential commercial nature or in the event we receive repeated requests for the same data. Nevertheless, we will notify you of the reasons for not being able to accede to your request. Please also note that we may exercise our discretion in allowing the corrections requested and/or may require further documentary evidence of the new data to avoid fraud and inaccuracy.
